§ 1

Scope

These terms and conditions contain the exclusively applicable terms and conditions between you and me,

§ 2

Product Selection
(1) You have the option to select and order items from my website.

(2) You can click on the desired items on the website. These will be collected in a virtual shopping cart, and at the end of your purchase, you will receive a summary of all items with the total price.

(3) Before submitting the order, I allow you to review the order for its correctness, especially regarding price and quantity, and to correct it if necessary.

§ 3

Data Protection
Regarding data protection, my data protection information applies.

§ 4

Conclusion of Contract
The presentation of my goods does not constitute a binding offer on my part. Only your order of a good is a binding offer according to § 145 BGB. In case of acceptance of this offer, I will send you an order confirmation by e-mail.

§ 5

Validity and Compliance with Legal Provisions, particularly §§ 86, 86a StGB
(1) I point out that any requested and supplied contemporary and military-historical goods, especially those from the National Socialist period, are delivered only for purposes of civic education, defense against unconstitutional and anti-constitutional endeavors, scientific and art-historical research, education and reporting on current events, or military-historical and uniform-related research, and thus comply with §§ 86, 86a StGB as well as other applicable law.

(2) As a buyer, you legally commit with your order to acquire these objects only for historical-scientific purposes for the reasons mentioned in paragraph 1 and not to use them in any propagandistic way within the meaning of §§ 86, 86a StGB or in any other criminal or unconstitutional manner. Orders are accepted only under this condition.

(3) Cutting, stabbing, and thrusting weapons are only sold to persons who have reached the age of 18. As proof, please send me a copy of an identification document.

§ 6 Payment Terms
(1) The purchase price is due immediately upon conclusion of the contract. Payment for the goods is generally made by cash on delivery or advance payment or payment providers such as Paypal or similar.

(2) All prices are to be understood as end customer prices. Furthermore, shipments to non-EU countries are tax-free export deliveries according to § 4 No. 1a UStG. Prices of items are shown including statutory VAT.

§ 7

Retention of Title
The goods remain my property until full payment.

§ 8

Delivery Conditions
Delivery will be made in the order of receipt of orders. Applicable shipping costs are listed in the catalog and during the ordering process and will be shown separately on the invoice. I point out that higher shipping costs, customs duties and fees or similar may apply for international shipments.

§ 9

Information on the Right of Withdrawal and Instruction:

Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity:

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

by means of a clear declaration (e.g., a letter sent by post, or e-mail) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, which is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract has been received by us. For this repayment, I will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment. I may refuse repayment until I have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to me without undue delay and in any case no later than fourteen days from the day on which you notify me of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking the quality, characteristics and functioning of the goods.

§ 10

Warranty
(1) All goods offered by me are genuine contemporary originals, unless expressly described as collector's reproductions. The descriptions are made to the best of my knowledge and belief. I guarantee a right of return for originality for 6 months from the date of dispatch.

(2) If there is a defect subject to warranty, you are entitled to demand subsequent performance, withdraw from the contract, or reduce the purchase price within the framework of the statutory provisions.

§ 11

Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the state in which you have your habitual residence remain unaffected.

(2) The place of jurisdiction is Hoya / Germany.

(3) Should individual provisions of this contract be invalid or contradict legal regulations, the remainder of the contract shall not be affected thereby. The invalid provision will be replaced by the contracting parties by mutual agreement with a provision that comes closest to the economic sense and purpose of the invalid provision in a legally effective manner. The above provision applies accordingly to loopholes.

§ 12 Alternative Dispute Resolution
The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
